First National Collection Bureau Litigation

Goldenberg Schneider recently joined Minnilo & Jenkins Co., LPA in filing a putative class action in federal court against First National Collection Bureau, Inc. (“FNCB”).  The Complaint alleges that FNCB engages in illegal telemarketing and debt collection activities in violation of the Telephone Consumer Protection Act, 47 U.S.C. 227 (“TCPA”), the Fair Debt Collection Practices Act, 15 U.S.C. 1692 et seq., and the Ohio Consumer Sales Practices Act, Ohio Rev. Code 1345.02 et seq.  More specifically, the complaint alleges that FNCB negligently or willfully calls consumers’ cellular phones without their express consent, harasses consumers with repeated debt collection calls, and uses technology to manipulate caller ID systems to disguise its identity.  The case is titled Brown v. First National Collection Bureau, Inc., Case No. 13-CV-524,  and is pending before Judge S. Arthur Spiegel in the United States District Court for the Southern District of Ohio.
