Goldenberg Schneider Files Class Action Against Toby Keith’s on Behalf of Unpaid Employees

Goldenberg Schneider, joined by Minnillo & Jenkins, LPA, recently filed a putative class action in federal court against Boomtown Entertainment LLC, Arizona Universal Holdings LLC,  CRGE Cincinnati LLC, and Frank Capri, the joint owners and operators of the now-shuttered Cincinnati restaurant, Toby Keith’s I Love This Bar and Grill.  The suit alleges the Defendants violated the Worker Adjustment and Retraining Notification Act (“WARN Act”) by abruptly closing the restaurant two days after Major League Baseball held its All-Star Game at the neighboring Great American Ball Park without providing necessary prior notice to employees as required by federal law.  The suit also alleges that the Defendants violated state and federal wage laws, and committed fraud and civil conspiracy, by knowingly sending employees bad paychecks that can’t be cashed due to insufficient funds.  The case is currently pending before Judge Michael R. Barrett in the United States District Court for the Southern District of Ohio.
