Goldenberg Schneider Files BlueTEC Diesel Class Action Against Mercedes-Benz

Goldenberg Schneider has joined forces with attorneys from Hagens Berman Sobol Shapiro LPP, Carella, Byrne, Cecchi, Olstein, Brody & Agnello, P.C., and the Law Offices of David Freydin, PC, in bringing a putative class action against Mercedes Benz USA, LLC for its wrongful and deceptive actions in the marketing and sale of vehicles equipped with BlueTEC “Clean Diesel” engines.  The BlueTEC name is a trade name used to describe a number of in-cylinder and after-treatment technologies used to reduce emissions.  Mercedes promotes its BlueTEC vehicles as “the world’s cleanest and most advanced diesel,” featuring “up to 30% lower greenhouse-gas emissions than gasoline.” 

However, Mercedes recently admitted that its BlueTEC vehicles are programmed to turn off certain emission reduction systems whenever ambient temperatures drop below 50 degrees Fahrenheit.  Moreover, real world testing has confirmed that Mercedes’ so-called “Clean Diesel” cars produce emissions at levels up to 65 times the U.S. standard. 

Affected models include the following diesel-powered models:  ML 320, ML 350, GL 320, E320, S350, R320, E Class, GL Class, ML Class, R Class, S Class, GLK Class, GLE Class, and Sprinter vans.

The action is currently pending before in the United States District Court for the District of New Jersey.
