Goldenberg Schneider Files First Audi Class Action for Emissions and Gas Mileage Fraud

Goldenberg Schneider has joined forces with attorneys from Hagens Berman Sobol Shapiro LPP, and Minnillo & Jenkins, Co. LPA, in bringing the nation’s first putative class action against Audi of America, LLC and Audi AG (collectively, “Audi”) for their wrongful and deceptive actions in the testing, marketing, and sale of vehicles equipped with 3.0-liter gasoline engines and automatic transmissions.  Those vehicles are alleged to have been manufactured to contain secret software designed to exaggerate the vehicles’ fuel efficiency and understate the vehicles’ emissions by modifying transmission shift patterns during vehicle testing only.  According to credible reports, the software detects when a vehicle undergoes emissions or mileage testing and instructs the transmission to shift into higher gears sooner than normal in order to artificially reduce fuel consumption and CO2 emission levels.  However, during normal driving operation, the vehicles’ shift points remain higher for better vehicle performance, but fuel consumption and CO2 emissions are significantly worse than represented by Audi.

Affected models include Audi Q5, Q7, A6, and A8 vehicles for model years 2013-2016. 

The action is currently pending before in the United States District Court for the Northern District of Illinois.
