Court Preliminarily Approves Nationwide Plantronics BackBeat Fit Headphones Settlement

On August 13, 2019, Judge Nathaniel M. Cousins of the U.S. District Court for the Northern District of California granted preliminary approval to a nationwide class action settlement negotiated by Goldenberg Schneider and its co-counsel in Shin v. Plantronics, Inc., N.D. Cal. 5:18-cv-05626-NC. The settlement provides eligible class members with either (1) a $50 cash payment; (2) a $25 cash payment; or (3) an extended warranty. 

The Court set a fairness hearing for December 20, 2019.  If granted final approval, the settlement will successfully resolve claims for the nearly 1.3 million class members who purchased BackBeat FIT wireless headphones that were marketed as “sweatproof” and “waterproof” and rechargeable for up to 8 hours when they are not.  The Court will hold a hearing on December 20, 2019 to decide whether to grant final approval.  The deadline to submit a Claim Form is December 31, 2019.
